Overview:

Chinese State Administration for Market Regulation’s (SAMR) Standard Committee released a compulsory national standard GB 41700-2022 for e-cigarette on April 8th 2022. The new standard, drafted by SAMR and China Tabaco, along with Chinese tobacco standardization committee and other relevant technical organizations, defines the following issues:

1. The terms and definitions of electronic cigarette, smoke, etc.
2. Essential requirement of e-cigarette design and raw material.
3. Technical requirement on e-cigarette device, smoke and released substance, and methods of test.
4. Requirement on e-cigarette signs and manual.

Implementation

China Tabaco issued Electronic Cigarette Management Regulation on March 11^th 2022, and the rule, which has addressed that e-cigarette shall follow the mandatory national standards, was implemented on May 1^st. The compulsory standard will come into force on October 1^st 2022. Considering the implementation date of the Electronic Cigarette Management Regulation, there will be a transition period until September 30^th. After the end of transition period, businesses around e-cigarette shall strictly follow the laws of Law of PRC on Tobacoo Monopoly, Regulation of implementing Law of PRC on Tobacoo Monopoly and Electronic Cigarette Management Regulation.

Requirements on batteries

As a critical component of e-cigarettes, it’s been addressed in GB 41700-22 that batteries shall meet SJ/T 11796 where defines requirements on signs and safety.

Note: SJ/T 11796 has not been issued yet. Further information about the standard will be listed after publish.

Extras

The relevant government department will start surveillance on e-cigarette after the standard is issued. The companies of e-cigarette business should follow the requirements on every stage, including producing and selling; meanwhile they should regularly check and inspect products to ensure the satisfactory on requirements.
